Trackd Software Licence
Licence terms for Trackd apps, mount firmware, tracking models and connected services.
Version 2026-10-26. Read alongside our Terms of Service and Privacy Policy.
Last updated: 26 October 2026
Who this agreement is with and what it covers
This software licence is between you and CBH Collective Pty Ltd (ABN 54 683 364 641), trading as Trackd Sports. Contact: trackd@trackdsport.com.
It covers proprietary Trackd application software, mount firmware, distributed tracking models and associated documentation supplied to you, and your authorised access to Trackd APIs and connected services (together, Trackd Technology). It applies when presented to you and accepted as part of your agreement with Trackd. It does not transfer ownership of Trackd Technology or change ownership of hardware you buy.
Your licence and permitted use
We grant you a non-exclusive licence to install and use the Trackd software made available to you on supported devices you own or control, and to use supplied firmware with your Trackd hardware, for its intended recording, tracking and connected-service functions. Access remains subject to any disclosed plan or subscription conditions.
You may use Trackd for personal, club, coaching and commercial filming, and edit, publish and commercially use your own recordings, subject to other people’s rights. This licence does not give Trackd ownership of your recordings. Any permission to process recordings or diagnostics is addressed separately in our Terms of Service and Privacy Policy.
You may transfer firmware installed on a mount with a lawful transfer of that mount. This does not transfer your account, credentials or separately licensed app subscriptions.
Reverse engineering and protection of Trackd Technology
Except with our written permission, as permitted by applicable third-party licences, or to the extent applicable law permits the activity despite this restriction, you must not reverse engineer, decompile, disassemble or otherwise attempt to derive source code, extract proprietary model weights or reconstruct non-public implementations from Trackd Technology.
Subject to those same exceptions, you must not copy, modify, distribute, sell, sublicense or create derivative works of Trackd Technology beyond the rights granted in this licence; remove proprietary notices; bypass technical access controls to obtain unauthorised access; or use non-public code, models, credentials or other protected materials obtained without authorisation to build or supply another product or service.
These restrictions concern protected Trackd materials and unauthorised access. They do not claim ownership of general ideas, publicly available information or independently developed technology, or prohibit lawful competition.
Rights and exceptions that remain available
Nothing in this licence excludes or restricts rights that cannot lawfully be excluded, including under the Australian Consumer Law or the Copyright Act 1968 (Cth). This includes applicable statutory permissions relating to studying a program’s ideas and functioning, backup copies, interoperability, error correction and security testing, subject to the conditions of those permissions. You do not need our permission to exercise a right that the law preserves despite this licence.
Open-source and other third-party components remain governed by their applicable licences. Where those licences grant additional rights or conflict with these restrictions for those components, the relevant component licence applies. Nothing here restricts legally protected repair or consumer remedies.
App-store terms and other Trackd policies
For an app obtained through Apple’s App Store, the applicable Apple standard or properly designated custom end-user licence and platform usage rules continue to apply. This document does not by itself replace Apple’s standard EULA or change an App Store Connect licence designation. Applicable distribution-platform requirements prevail where required.
The Trackd Terms of Service also address purchases and services. The Privacy Policy explains personal-information handling. This licence does not expand data collection or override privacy choices or mandatory privacy rights.
Material breaches and termination
If you materially breach this licence, we may terminate the affected licence or restrict the affected service only where reasonably necessary and proportionate to protect our rights, users or services. Where practicable, we will explain the breach and give a reasonable opportunity to remedy it before taking action. Immediate restrictions may be necessary to address an active security threat or unlawful access.
Termination does not remove consumer guarantees, accrued refund rights or ownership of your hardware and recordings. This clause does not authorise us to erase your recordings or remotely disable your mount. We will provide a reasonable opportunity to retrieve your data where lawful and technically practicable.
Changes to this licence
We will identify revised versions and explain material changes before asking you to accept them where required. Posting a revised document alone does not establish your acceptance or retroactively change the licence already agreed with you. Your statutory rights remain unaffected.
Consumer rights, disputes and contact
This licence does not exclude statutory guarantees or limit remedies that cannot lawfully be limited. If any provision is unenforceable, it applies only to the extent lawful and the remaining provisions continue to operate to the extent possible.
Please contact trackd@trackdsport.com about licence permissions, open-source notices or disputes. This does not restrict your right to approach a regulator, tribunal or court with jurisdiction.
